What to include in your notice
To be effective, a notice of claimed infringement must include all of the following (per 17 U.S.C. § 512(c)(3)):
- A physical or electronic signature of the copyright owner or person authorized to act on their behalf.
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material that is claimed to be infringing or the subject of the infringing activity, with enough information for us to locate it (such as the full URL on TechLift).
- Your name, mailing address, telephone number, and email address.
- A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
Counter-notice
If you believe content was removed in error, you may submit a counter-notice. It must include your contact information, identification of the removed material and where it appeared before removal, a statement under penalty of perjury that you have a good-faith belief the removal was a mistake or misidentification, and your consent to the jurisdiction of the federal district court for the district where you reside (or, if outside the U.S., the Southern District of Iowa).
Repeat infringers
TechLift terminates accounts of users determined to be repeat infringers in appropriate circumstances.
Misrepresentations
Under 17 U.S.C. § 512(f), you may be liable for damages, including costs and attorneys' fees, if you knowingly materially misrepresent that material is infringing or that material was removed by mistake. Please be sure your claim is accurate before sending notice.
